Welcome to Medvily! These Terms and Conditions (“Terms”) govern your access and use of Medvily, a marketplace offering on-demand services to medical professionals. By accessing or using our platform, you agree to comply with these Terms. If you do not agree, please do not use Medvily.
1. Definitions
- “Medvily,” “we,” “us,” or “our” refers to Medvily, a company based in California, USA.
- “User,” “you,” or “your” refers to any person or entity accessing or using Medvily.
- “Service Provider” refers to any medical professional or expert offering services through Medvily.
- “Client” refers to any individual or entity purchasing services on Medvily.
- “Services” refers to on-demand medical-related freelance services available on Medvily.
2. Eligibility
To use Medvily, you must be at least 18 years old and legally capable of entering into a binding contract. By using our platform, you confirm that you meet these requirements. If you are using Medvily on behalf of an organization, you confirm that you have the authority to bind the organization to these Terms. We reserve the right to request verification of your age or identity at any time.
3. User Accounts
- To access certain features of Medvily, you must create an account by providing accurate and complete information.
- You must keep your account credentials secure and confidential.
- You agree not to share your account with others or allow unauthorized access.
- You are responsible for all activity that occurs under your account.
- If you suspect unauthorized access or a security breach, you must notify us immediately.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or unlawful activities.
4. Services and Transactions
- Medvily provides a marketplace platform that connects Clients with Service Providers. We do not offer or provide medical advice, diagnosis, or treatment.
- Service Providers are solely responsible for the quality, accuracy, and legality of their services. Clients are responsible for verifying a provider’s credentials and suitability before engaging their services.
- All transactions must be conducted through the Medvily platform, and external communications or payments outside of the platform are prohibited.
- Medvily reserves the right to remove any listings or services that violate our policies or applicable laws.
- We are not liable for disputes between Clients and Service Providers, though we may mediate disputes at our discretion.
5. Fees and Payments
- Medvily may charge service fees for transactions conducted on the platform. These fees will be clearly communicated before a transaction is finalized.
- Payments are processed through third-party payment providers. By using Medvily, you agree to comply with the payment provider’s terms and conditions.
- Clients must make full payments before services are delivered, unless otherwise agreed upon between the parties.
- Service Providers will receive payouts after service completion, subject to any applicable processing times.
- All fees paid to Medvily are non-refundable unless explicitly stated otherwise.
6. Cancellations and Refunds
- Clients may cancel a service request before it is accepted by a Service Provider without incurring charges.
- Once a Service Provider accepts a request, cancellations and refunds are subject to the provider’s policy and our Refund Policy.
- If a Service Provider fails to deliver the agreed-upon service, Clients may be eligible for a refund.
- Disputes regarding service quality or non-fulfillment should be resolved between the Client and the Service Provider. Medvily may assist in mediation at its discretion.
- Refunds will be processed through the original payment method and may take several business days to reflect.
7. Prohibited Activities
Users agree not to:
- Violate any applicable laws, regulations, or industry standards.
- Use the platform for fraudulent, deceptive, or unauthorized purposes.
- Impersonate another person, misrepresent credentials, or falsify information.
- Post, distribute, or transmit harmful, illegal, or offensive content.
- Attempt to interfere with the security, functionality, or performance of Medvily.
- Circumvent or manipulate payment processes or platform policies.
8. Intellectual Property
- Medvily and its content, including trademarks, logos, text, images, and software, are protected by intellectual property laws.
- Users may not copy, modify, distribute, or use our content without prior written permission.
- Service Providers retain ownership of their original content but grant Medvily a limited license to use it for promotional purposes.
9. Limitation of Liability
- Medvily is a marketplace platform and does not assume liability for services provided by third-party Service Providers.
- We do not guarantee the accuracy, reliability, or outcomes of services offered through Medvily.
- Under no circumstances shall Medvily be liable for indirect, incidental, or consequential damages arising from your use of the platform.
- Our total liability, if any, shall be limited to the amount paid by you for services on Medvily within the last 12 months.
10. Indemnification
You agree to indemnify, defend, and hold Medvily, its affiliates, and employees harmless from any claims, liabilities, damages, or expenses arising from:
- Your use or misuse of the platform.
- Your violation of these Terms.
- Any disputes between you and another user.
11. Termination
- Medvily reserves the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activities, or pose a risk to the platform’s integrity.
- Users may deactivate their accounts at any time, but certain obligations under these Terms will survive termination.
- Medvily is not responsible for retaining or providing access to user data after account termination.
12. Governing Law and Dispute Resolution
- These Terms are governed by the laws of California, USA.
- Any disputes shall be resolved through binding arbitration in California, unless otherwise required by law.
- By using Medvily, you waive your right to participate in class-action lawsuits.
13. Changes to These Terms
- We reserve the right to update or modify these Terms at any time. Material changes will be communicated to users through email or platform notifications.
- Continued use of Medvily after changes indicates acceptance of the revised Terms.
